Terms of use
Last updated: 10-29-2026
Draft for legal review. These terms are a first draft. They have not been reviewed by a lawyer yet and are not final.
These terms are the agreement between you and me, Lucas Lukowski, an independent developer in Edmonton, Alberta, Canada, for using Sama Sama: the iPhone and Android apps and the event guest pages. By making an account or using the app, you agree to them. The privacy policy explains what information the app holds and why.
It is still in testing
Sama Sama is being tested before its public release. Things will break, features will change, and the test server's data can be reset at any time. Please keep a copy of anything you would mind losing.
Who can use it
The app is not meant for anyone under 16. You need your own account to use it, and you are responsible for what happens on it, so keep your phones, passkeys and recovery key safe. If you lose your recovery key and every phone signed in to your account, I can't get your content back, because I never have the keys to it.
Your content
What you write and share in the app is yours. It is end-to-end encrypted, so I can't read it, and I don't claim any rights to it. The only exception is a report: if you report someone, the messages you choose are sent to me as text so I can review them.
You need the right to share what you share. When you share something with other people in a space, they get a copy, and it stays with them even if you later delete your account.
Using it fairly
Please don't use the app to:
- harass, threaten or bully anyone,
- send spam, or sexual content to people who did not ask for it,
- pretend to be someone else,
- share anything that is against the law, or that you don't have the right to share,
- try to get into accounts or data that aren't yours, or to break or overload the service.
Because content is encrypted, I can't see what happens in your spaces. If someone bothers you, you can block them, and you can report their messages from the app. Reports come to me to review.
Closing your account
You can delete your account at any time in Settings, or by email if you no longer have the app. Deleting your account explains how, and what is kept.
I may close an account that breaks these terms, or close the service. The app has no way to close someone else's account yet, so how this works is still open.
Sticker packs
Some sticker packs cost money. You buy them through the App Store or Google Play, which shows the price before you buy and handles the payment. Refunds are handled by Apple or Google under their own rules, so ask them. A pack you bought works on all the phones signed in to your account.
No warranty
The app is provided as it is, and while it is in testing especially, I can't promise it will always work, be available, or keep your data. I do my best, and that is all I can promise.
Limits of liability
As far as the law allows, I am not responsible for losses that come from using the app or not being able to use it, such as lost data, missed events or what other people send you. Where the law does not allow that limit, my responsibility is limited to what you paid me in the twelve months before the problem, which for most people is nothing. Nothing here takes away rights you have under consumer protection law where you live.
Governing law
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there.
Changes
If these terms change, the date at the top will change. If you keep using the app after that, the new terms apply.
